Some regulations state that no bid/call above 3NT may be alerted. It's clear what is intended but it's short through the corner. When you take it to the letter you get a different story to what is intended. Pass, Double and ReDouble cannot be compared to 3NT.

Proof:
I can Dbl over RHO's 1♥ and anyone can bid 1♠ over my Dbl. So 1♠ must be higher than Dbl. Also, I can Dbl over RHO's 4♥, so Dbl is higher than 4♥. Dbl < 1♠ < 4♥ < Dbl, this is impossible. Therefore it's comparing apples and oranges.

So, should one alert forcing passes (or other meanings for pass/Dbl/RDbl) when the auction is higher than 3NT? Or should we be stubborn until the regulators make work of a decent description of their alerting rule?

In the EBU, which in general has a "no alerting above 3NT" rule, the regulations give a small number of exceptions:

i) conventional opening bids;
ii) lead-directing passes;
iii) lead-directing doubles which ask for the lead of a suit other than that doubled.

They also say "once the auction is above the level of 3NT", which seems to deal with your other worry.

However, at the Gatlinburg Regional in the A/B Open Pairs (750/2000 MP) we were allowed to play Kaplan Inversion and Mult-Landy - two Mid-Chart Conventions. Go figure.
