Are you referring to the situation where partner bids 3 over 3 in comp? If so, he is just competing for a part score and hopefully keeping the Law in mind.
Here's what I play when I can bid 3 over the opp's 3.
1) All 3 over 3's are NOT intended as game tries and I keep the Law in mind.
2) If there is an inbetween suit it is used as an all purpose quant game try. ie...
opps bid 3♦ and our trumps are ♠. Then 3♥ is any game try..ie "are you near max partner, and do you like your hand for game?" and 3♠ is fighting for the part score.
3) If there's no inbetween suit double is any game try. Others may wish to not use game try doubles and have no game try in this situation and make all doubles penalty.
4) When there is an inbetween suit for a game try, double becomes penalty.

y 3 over 3 in comp and then i make a game try since i assumed a wide range........pard rebids 3nt..not 4 of minor.
I repeat pard makes 3 over 3 and then I make game try.

You have to be more specific about what auctions you are talking about. Are these situations where you have already raised the minor? If you've already shown support, then partner's 3 over 3 is competitive, you should never make a game try; if you really have enough to game try you should have made a stronger bid the first time around. Give an example auction.
